By using this service, you agree to allow Thomas R. Clifton and ES Designs (ES Designs) to store and make available your sites via the World Wide Web.

ES Designs is not liable for any damages related to the use of this system.

ES Designs does not make any guarantees, either written or implied, as to the usability of this service for any purpose.

ES Designs will not be held liable in any manner for loss of data resulting from the use of this system.

ES Designs does not accept any liability based on the content posted on any member's website.

Prohibited activities

You will not use any services provided by ES Designs in any manner which is illegal in your locality, or would be considered illegal according to the laws of California, or the United States of America.

You will not use any services provided by ES Designs for purposes of distributing pornography or to promote hatred, or harass or menace an individual or group.

You will not infringe on the intellectual property of others. You will not use intellectual property belonging to ES Designs for any purpose unless given permission to do so.

Rights

ES Designs reserves the right to deactivate your account or websites, at any time, with or without advance notice. ES Designs will provide a prorated refund if we deactivate your web sites.

Userland claims copyright ownership of all user interface elements presented within the Userland owned themes, as well as for the look and feel of Manila's user interface. You and your members retain the rights to any copyrighted material, including templates, which you/they post on your website or subsites.

Modification of this agreement

ES Designs can modify this agreement at any time. If you do not agree with the modifications, you have 30 days to cancel your agreement with ES Designs and receive a prorated refund.
